Terms of Service

1. Who we are

My Cigar Shelf is a product of Nisshagen Advisory AB (Org.nr 559526-6742), a company registered in Stockholm, Sweden. “We”, “us” and “our” refer to Nisshagen Advisory AB. Questions about these terms: hello@mycigarshelf.com.

2. What this site is

The site has four parts. A registry of about 5,900 cigars across 219 marques, with the specifications we hold for each: vitola, length and ring gauge, wrapper, origin, strength and a description. A set of care pages about holding a humidor at a stable humidity and what goes wrong when it drifts. A gear page, a short list of the keeping accessories the care pages describe, linked to Amazon.se as section 6 sets out. And your humidor, a page that shows the collection recorded against your account in the My Cigar Shelf app.

The app is still being built and has not been released. Nothing on this site is an offer, a commitment to release anything, or a guarantee of any feature, date or price. Descriptions of intended functionality may change or be abandoned.

3. Age requirement

This site concerns cigars and is intended for adults who are of legal age to purchase tobacco products in their country of residence. By using the site, you confirm that you meet that requirement. We do not sell tobacco, and nothing here is an inducement to smoke: the site is about keeping a collection in condition, not about consuming it.

4. Your account and your content

Signing in is optional. Only the humidor page needs an account, and the rest of the site is open to anyone.

The account is the ShelfHub account, shared across the “my X shelf” apps, so one login works for all of them. Your cigar records are not shared with those apps; only the login is common. You are responsible for keeping your credentials secure and for what is done through your account.

The humidors, cigars, dates and notes recorded against your account are yours. We claim no ownership of them. We store and process them only to provide the service, as set out in the Privacy Policy. We do not publish them, and they are not visible to other users.

This site reads that record and does not change it. Everything that writes to your shelf happens in the app.

You may have your account and its records deleted at any time by writing to hello@mycigarshelf.com. Deletion is permanent. Section 8 of the Privacy Policy explains how deletion works when the login is shared with another app, and what the Delete account button in the account panel does today.

5. The registry and its photographs

The registry is our own editorial record, assembled from public sources. It is provided as-is and may be incomplete, out of date or wrong. Most rows carry only some of the fields, and the site shows what a row holds rather than filling the gaps with a guess. Check anything that matters against the band and the box in your hand.

The photographs beside cigars are not ours. They are linked from the two retailers that published them, cigarworld.de and neptunecigar.com, and are served from those retailers’ own servers rather than copied onto ours. They remain the property of whoever owns them, and we grant you no rights over them. If you hold rights in one of these images and want it gone from the registry, write to us and we will remove the link. The Privacy Policy describes what those requests mean for you as a reader.

My Cigar Shelf is not affiliated with, endorsed by, sponsored by or connected to either retailer, or to any manufacturer, marque or brand named in the registry. Names and trade marks belong to their owners and are used here for identification.

6. Commerce, and where it stops

We sell nothing on this site. There is no basket and no checkout. Our database holds prices for many cigars and this site does not read them, because a price on a page reads as an offer.

The site does carry affiliate links to Amazon.se. They appear on the gear page, and on the humidor page when a reading drifts or goes stale. Every one points at keeping gear: packs, hygrometers, boxes and the like. My Cigar Shelf is an Amazon Associate and earns a commission on qualifying purchases made through those links. The price you pay does not change. Every such link is marked Ad.

No link on this site leads to a cigar or to any other tobacco product. The care pages and the support page carry no commercial link. We still have no arrangement with the two retailers whose photographs appear in the registry, and no commission comes from them. Apple’s App Store guideline 1.4.3 and the EU Tobacco Advertising Directive bear on that line, and it stands. Version 2.0 of these terms promised that a change to this section would be written here before anything on the site changed; this version was published in the same release that switched the links on, so the page did not run ahead of the terms.

7. What you may not do

• Use the site for any unlawful purpose
• Attempt to gain unauthorised access to the site, its hosting, its database or another user’s account
• Use automated tools to scrape, bulk-extract, overload or probe the site or the registry
• Resell, redistribute or commercially exploit the registry or any other part of the site
• Republish the cigar photographs, which are not ours to license to you
• Copy or reproduce the design, code, text or branding without written permission

8. Intellectual property

My Cigar Shelf, including this site and its design, code, copy, editorial text and branding, is owned by Nisshagen Advisory AB. You may not reproduce, distribute or create derivative works from it without written permission. This does not affect your ownership of what you record on your own shelf, and it does not extend to the retailer photographs described in section 5, which belong to their owners.

9. Availability and changes

We may change, suspend or discontinue any part of the site. Where it is practical, we will give reasonable notice of a change that materially reduces what the site does. We do not guarantee uninterrupted or error-free operation. The registry pages are cached and can be up to an hour behind the database, and the photographs depend on servers we do not control, so a picture can disappear without anything having changed here.

10. Disclaimers

The site is provided “as is” and “as available”. We make no warranty that it will be uninterrupted or error-free, or that any information on it, including registry data and the figures in the care pages, is accurate, complete or current. Any statement about a future feature is a statement of present intention only.

The care pages describe common practice for keeping a humidor and the numbers we work to. They are general information rather than a warranty that following them will preserve anything you own. Humidors, rooms and climates differ, and the responsibility for what sits in your box is yours.

Nothing on this site is health, legal or financial advice. Tobacco carries serious health risks, and its sale and use are regulated differently in every country; complying with the law where you live is your responsibility.

Keep your own record of anything you would be upset to lose. We take reasonable care with your data and we do not guarantee against data loss.

11. Limitation of liability

To the extent permitted by Swedish law, Nisshagen Advisory AB is not liable for any indirect, incidental or consequential damages arising from your use of this site, from any reliance on registry data, on what the humidor page shows, or on the care guidance, or from any statement about an unreleased app. Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud, and nothing in them affects the mandatory rights of a consumer under Swedish law.

12. Changes to these terms

We may update these terms. When we do, we will publish the updated version here and update the version number and effective date at the top of this page. Continued use after that constitutes acceptance.

13. Governing law

These terms are governed by Swedish law, and disputes will be resolved in Swedish courts. If you are a consumer resident in the EU, this does not deprive you of the protection of the mandatory rules of your own country.
